PFAS & National Defense Authorization Act (NDAA)
In December, the House & Senate released the 2020 National Defense Authorization Act. The National Association of Clean Water Agencies (NACWA) has been tracking this regulatory development and providing input on the potential inclusion of PFAS as a hazardous substance under CERCLA (Comprehensive Environmental Response, Compensation, and Liability Act ) also known as Superfund or as a pollutant under the Clean Water Act (CWA). NACWA has advocated against the inclusion of PFAS in these regulations as it is not science-based and would create significant liability for the water and wastewater sector. NACWA announced that the final NDAA does not include PFAS for CERCLA or the CWA, however, it does include requirements such as phasing out the use of PFAS-containing firefighting foams by the Department of Defense by 2024 as this is a significant contributor to PFAS in the environment. - Idaho - February 19
- Oregon - February 19
- Washington - March 1
The U.S. Environmental Protection Agency (EPA) will be hosting report training on the following dates:
